Terms of use
Last updated
How’s the Job is a trading name of Mather Software Ltd, registered in England and Wales, company number 17443861. ICO registration ZC256628. Companies House record.
These terms are between you and Mather Software Ltd, who runs How’s the Job. By creating an account you agree to them. If you only opened a job link someone sent you, the parts about accounts and content don’t apply to you.
The service
How’s the Job lets a tradesperson post photos, updates and the status of a job to a page their customer can open from a link. It is free to use. If we ever add paid features we will say so clearly before anything is charged, and nothing will be charged without you agreeing to it. Customers never pay.
Your account
Keep your sign-in details to yourself. You are responsible for what is posted from your account. You must be 18 or over and using the app for your trade or business.
What you post
- Only add a customer’s details, and only post photos of their property, where you have a reason to and they would expect it — usually because you are doing the job for them.
- Anyone with a job link can open it. Send it only to your customer or people they’ve asked you to include.
- Don’t post anything unlawful, abusive, or that you don’t have the right to share.
- You keep ownership of your photos and words. You give us permission to store them and show them on the job page, and nothing more.
Our privacy policy explains how that data is handled.
Data processing
When you add your customers’ names, phone numbers and addresses, and post photos and updates about their jobs, you are the controller of that personal data and Mather Software Ltd is your processor. This section is the agreement UK GDPR Article 28 requires between us. For that data we will:
- process it only on your documented instructions — which are these terms and how you use the app — to store it, show it on the job pages you share and delete it when you ask, unless the law requires otherwise (in which case we will tell you first where the law allows);
- make sure everyone we authorise to process it is bound by confidentiality;
- keep it secure with appropriate technical and organisational measures, as Article 32 requires, including encryption in transit, access controls and unguessable job links;
- use sub-processors only as listed in our privacy policy. You give us general authorisation to use them; we will tell you by email or in the app before adding or replacing one, so you can object, and we impose the same data protection obligations on each of them as these terms impose on us, remaining responsible to you for their work;
- help you, as far as we reasonably can, to answer your customers’ requests to exercise their rights, and to meet your own obligations on security, breach notification, impact assessments and consulting the ICO (Articles 32–36);
- tell you without undue delay after we become aware of a personal data breach affecting it, with the information you need;
- when you close your account or ask us to, delete it (or return it to you first if you ask), unless the law requires us to keep it; deleted data leaves our backups within 30 days;
- give you the information you need to show that these obligations are met, and allow for and contribute to reasonable audits, including inspections, by you or an auditor you appoint, on reasonable notice.
You are responsible for having a lawful basis to add your customers’ details and for telling them how they are used; you can point them to our privacy policy. We will tell you straight away if we think an instruction of yours breaks data protection law.
Keeping it working
We try to keep How’s the Job running and your data safe, but it is provided as it is, and we can’t promise it will never be unavailable or never lose anything. Keep your own copy of anything you can’t afford to lose. We may change or stop parts of the service; if we close it, we will give signed-up users notice first.
We may suspend an account that breaks these terms or puts other people at risk. Anyone can report a job page to us from the link at the bottom of it. We will tell you about a report that concerns you, and we may take a job page down if it appears to break these terms or the law, or if the customer asks us to remove it and you don’t deal with their request.
Liability
We are not liable for indirect or consequential losses, such as lost work, profit, business or data. Otherwise, our total liability to you for all claims arising from these terms or the service is limited to the greater of the fees you paid us in the 12 months before the claim (while the app is free, that is nothing) or £100.
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law. If you are a consumer, your statutory rights are not affected.
Ending it
You can stop using the app at any time. You can delete your account and its data yourself with “Delete my account” under Edit details in the app, which deletes your jobs, photos, updates, your customers’ details and your sign-in, and stops every job link working. You can also ask us to do it by emailing support@mathersoftware.com.
Changes to these terms
If these terms change, the date at the top changes with them. For a material change we will tell signed-up users by email or in the app at least 30 days before it takes effect. If you don’t agree to a change you can stop using the app and close your account before it takes effect. Minor changes that don’t affect your rights, such as fixing typos, may take effect straight away.
Law and courts
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute about them. If you use the app as a consumer and live elsewhere in the UK, you keep the protection of your home country’s mandatory laws and can bring a claim in your local courts. Nothing in these terms affects your statutory rights. Questions go to support@mathersoftware.com.
